Home warranty rules in Kentucky

What the trade sells as a home warranty is, in law, a service contract: a paid promise to repair or replace named home systems and appliances. Kentucky's statute calls it a "service contract to repair, replace, or maintain consumer products". It is not a builder's or manufacturer's warranty and it is not homeowners insurance; the contract you receive governs.

The rules, in plain words

  1. A consumer product service contract is not insurance if its maker registers with the commissioner and proves net worth, or holds an insurance policy or performance bond. Source.
  2. Registration must be filed 30 days before the maker sells any contracts. It is renewed by March 1 each year, and there is no fee. Source.
  3. The financial test is a net worth of at least $100 million, or a policy or bond of at least the greater of $50,000 or 25% of Kentucky revenue. Source.

The roster

No roster of home service contract companies published by Kentucky could be confirmed in this build. If the state starts one, this sheet will print it as the state's own list on its own date. Registration, where a state keeps it, is not a quality rating.

Before you sign, in any state

  1. Ask for the full contract, not the brochure, and read the exclusions page first.
  2. Find the waiting period and the service call fee in the contract itself.
  3. Find the company that pays claims (the obligor) by name, and check that name on the state list if there is one.
  4. Note the cancellation terms and how a refund is figured.
