Home warranty rules in Montana

What the trade sells as a home warranty is, in law, a service contract: a paid promise to repair or replace named home systems and appliances. Montana's statute calls it a "service contract". It is not a builder's or manufacturer's warranty and it is not homeowners insurance; the contract you receive governs.

The rules, in plain words

  1. Service contracts governed by Title 30, chapter 14, part 13 are excluded from the insurance code. Source.
  2. Contracts may not be sold unless the provider has reimbursement insurance, a 40 percent reserve or 5 percent deposit (minimum $25,000), or $100 million net worth. Source.
