Home warranty companies in Virginia

What the trade sells as a home warranty is, in law, a service contract: a paid promise to repair or replace named home systems and appliances. Virginia's statute calls it a "home service contract". It is not a builder's or manufacturer's warranty and it is not homeowners insurance; the contract you receive governs.

The rules, in plain words

  1. Providers must register with the Commissioner of Agriculture and Consumer Services before selling, at $300 per year, renewed each July 1 with an audited financial statement. Source.
  2. Providers must keep a 40 percent reserve plus a $10,000 to $90,000 bond or letter of credit, or carry full reimbursement insurance instead. Source.
  3. Home service contracts are not insurance; providers with net worth over $100M are exempt from the chapter. Source.
